1.1 These General Terms and Conditions (GTC) govern the legal relationship between klose brothers GmbH (hereinafter referred to as the “Provider”) and the participants (hereinafter referred to as the “Participants”) of workshops booked via the Provider’s online platform.
1.2 The contract is concluded with klose brothers GmbH, Managing Directors: Jaroslaw Klose and Martin Klose, Nahariyastraße 1, 33602 Bielefeld, Germany, Commercial Register: Bielefeld Local Court, HRB 40234.
2.1 The subject of the contract are the workshops presented on the website of the Provider. The presentation does not constitute a legally binding offer, but an invitation to submit an offer.
2.2 The participant makes a binding offer to book a workshop by completing the order process on the provider’s website. The contract is concluded when the provider accepts the participant’s offer by confirming the booking.
3.1 The workshop prices are stated on the provider’s website and are inclusive of statutory VAT for private customers and exclusive of statutory VAT for commercial customers. The respective prices are explicitly stated.
3.2 Payment shall be made by invoice.
4.1 The registration for our workshops is binding and can only be cancelled after consultation with the organizer and includes the payment of a cancellation fee. The cancellation fee is staggered as follows: For cancellations less than 20 days before the agreed date, the cancellation fee is 50% of the workshop price. For cancellations less than 7 days before the agreed date, the cancellation fee is 100% of the workshop price. You are welcome to name a substitute participant instead of the registered participant. There will be no additional costs for this. Please inform us of the change by e-mail.
4.2 The provider reserves the right to cancel workshops for good cause (e.g. illness of the speaker, insufficient number of participants). In case of a cancellation on the part of klose brothers GmbH, we will arrange an alternative date together with you. If this is not feasible, you will not incur any costs for the workshop. 5.1 All workshop content, documents, and materials are subject to the copyright of the provider and may not be reproduced, distributed or otherwise used without express consent.
5.2 Participants are only granted the right to use the workshop content for personal purposes. Transfer to third parties or commercial use is prohibited.
6.1 The provider is liable for damages caused by gross negligence or intent according to the legal regulations.
6.2 In the event of slight negligence, the Provider shall only be liable in the event of a breach of material contractual obligations. In this case, liability is limited to the foreseeable damage typical for the contract.
7.1 klose brothers GmbH undertakes to maintain confidentiality with regard to the contractor’s technical and organizational internals that are made accessible to our employees/the trainer within the scope of the order. This shall also apply beyond the period of validity of the engagement
8.1 The provider’s privacy policy can be viewed on the website and regulates the collection, processing, and use of personal data.
9.1 We are neither willing nor obliged to participate in a dispute resolution procedure before a consumer arbitration board.
10.1 The law of the Federal Republic of Germany shall apply to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
10.2 Should individual provisions of these GTC be or become invalid, this shall not affect the validity of the remaining provisions.
10.3 The place of jurisdiction for all disputes arising from or in connection with this contract is the registered office of the Provider.
